Who and How to apply for GCMS Notes?


The Access to Information Act or the Privacy Act has issued a GCMS system allowing citizens to extract information about them from the federal government. One can apply for the notes if one is a citizen of Canada, a permanent resident of Canada or is in Canada at the time of the application. For instance, if the applicant does not fall in any of the above categories mentioned, one can apply or give an application through an agent who is a citizen or permanent resident in Canada. The agent will apply on his behalf to the Access to Information Act or Privacy Act.
One can also get a sponsor on behalf of the personal applicant, but a consent form is required for this purpose from the principal applicant along with a fee of $5. Then sponsors can apply to get access to information.


Time required for taking GCMS Notes


Immigration, Refugees and Citizenship Canada (IRCC) has been given 30 days to answer the application request. This period can be enlarged if there is a reasonable situation like there are vast numbers of requests or the request requires going over a considerable number of records which is impossible to be done within 30 days, and doing so will obstruct the government operations.
Extension of time may be necessary if the IRCC found the need to consult for the request. If the extension period is greater than the applicant will be informed by the IRCC. The period can extend from 30 to 60 days in a few situations.
Requests for GCMS notes will not impact or postpone visa applications.

When should one request GCMS Notes?


In case the applications are for permanent residence in Canada, one can request GCMS notes when the criteria relating to R10 completes. R10 is Regulation 10 of the Immigration and Refugee Protection Act, which is the step where the IRCC confirms and reviews whether all the documents and information required for the application process are complete or not. One can complete this stage within one month from the application given to IRCC. The appropriate time to file will be around 2nd to 3rd months after the application.
After the request of application for permanent or temporary residence has been handled and the decision has been made by the IRCC, one can request GCMS notes. If applications are rejected, the same will be mentioned by the IRCC to the applicant.

2: Unique Client Identifier (UCI) is given to the applicant after the process of application has been started, and there is only one UCI number assigned to the applicant irrespective of how many times he has applied.
